The agency disclosure is a set of documentation containing information about the role an real estate agent plays in regards to the property transaction.
The primary information that such a disclosure or declaration serves is to make it clear which side of the buyer or seller the agent represents.
This also serves to help clients who engage in an agent’s services uncover whether an agent is a dual agent, or even a sub-agent.
Both status of which would have material implications on the motivations of the agent.
For example, a buyer whose agent turns out to be a subagent of the seller’s agent would mean that his compensation would be paid by the selling broker. This can mean that the advice given to the buyer during the negotiation of sale might not be of the buyer’s best interest.
It must be noted that different state can have different requirements about what should be contained in an agency disclosure.
