Filled land describes an area of land that has it’s grade (level) increased due to deposits of soil, rock, dirt, clay, gravel, etc.

Such types of land usually have to be compacted regularly for safety and maintenance reasons.

Sellers of such land, including brokers, have a duty to disclose the status of it being filled land.

Failing which can lead to liability should a buyer suffer damages due to the condition of the land.

This is because filled land can be vulnerable to construction problems and safety issues.

Sometimes potholes can appear on filled land after a period of time. Homes that are built on it can also see foundation cracks due to excessive settlement.

However, disclosure might not be legally required if the land has been used for a long time and have not experienced any adverse issues throughout that period of time.
