Hiatus is a segment of land that lies between parcels of land belonging to different owners, but from legal records like a cadastral don’t appear to belong to any party.

This can present an odd situation for land owners as whenever there are questions marks over who owns a particular area of land, the dispute is often settled with reference to public records.

In this case, as public records also do not contain clear indication of ownership, it will be up to the court to determine the rightful owner fairly.

It is also possible that a court orders the deed to be reformed.
