An open and notorious possession of property describes an occupant of property making it very clear for a reasonable person to know that he is claiming some interest or title in it.

If the true legal owner of the property does not take action to enforce his rights, the stronger the case the occupants have the longer inaction is dragged.

In the process of adverse possession, one of the factors that can be detrimentally against the owner is rouge possession being open and notorious.

When this is the case, there is a strong chance for adverse possession of the occupants to succeed.

This is why land owners must take proper action to remove or prevent squatters from living in the premises of real estate belonging to them.

They could lose them otherwise.
